Suspension of expedited H-1B visas partially lifted

Some Florida companies may be able to arrange for foreign employees to get H-1B visas more quickly than in the past few months. On July 24, some employers were once again given the ability to expedite H-1B visa applications by paying for them. In March, this premium processing was suspended by U.S. Citizenship and Immigration Services. The reinstatement applies to H-1B visas that are exempt from the annual visa cap.

Hospitals, research institutions and nonprofits are among the employers that are not subject to the annual cap of 85,000. USCIS indicated that it might offer limited opportunities for premium processing for visas that are subject to the cap. In general, these are visas for employees at for-profit companies, and a lottery is used to distribute them.

Under the expedited process, companies only have to wait 15 days after paying $1,225 to learn whether an employee is eligible. The regular process may take months.

As this partial lifting of the suspension demonstrates, immigration law is undergoing a number of changes. A person who needs assistance with immigration in any way including people seeking political asylum, people seeking a green card or people who wish to apply for citizenship or permanent residency might want to consult an immigration attorney. It may even be possible to halt deportation in some circumstances. For a person who is seeking a way to come to the United States to work, study, invest or join family members, an attorney might be able to explain various options. In addition to changing immigration law, it is important that documentation and paperwork be accurate and completed in time or a case could be delayed or rejected.
