Some detainees freed as a result of executive action

In a recent post we wrote about some of the changes to the immigration system that individuals in the United States could expect as a result of President Obama’s executive action on immigration. Among other things the changes protect many immigrants from deportation. Since then, some of the changes outlined in the president’s plan have gone into effect.  

For example, according to U.S. Immigration and Customs Enforcement, some individuals who were held in detention centers throughout the country, have been released. The releases are a result of ICE implementing screenings to determine which individuals in custody are affected by the executive action. In addition, detainees can call a “Detention Reporting and Information Line” which was recently set up, to request that their case be reviewed by ICE.

While specifics regarding the number of individuals impacted have not been provided, an official with ICE indicated that the number will not be that high simply because only a small amount of detainees throughout the nation are eligible for release. Individuals who will not be released from detention include those who recently crossed into the country or who have serious criminal records. Those who are released will be based on the premise that they qualify for protection from deportation.

As is the case with most immigration matters there is often a lot of confusion surrounding the president’s executive order. This confusion is in part due to the fact that policies often change. In general, those who are best equipped to answer those questions are immigration lawyers.
