Priority dates for EB-3 visas moved up

Earlier this month we wrote about changes to the priority date for green card holders seeking F-2A visas. The priority date for those visas is current through this month as well as September. Recent United States Department of State Visa Bulletins have provided information that could be of interest to those in the Miami, Florida areas regarding other visa priority dates as well. One particular visa is the employment-based third preference, or EB-3, visa.

Employment-based third preference visas are designed to bring workers described as professional or skilled to work in the United States. Beginning this past April, the cut-off date applied to a majority of the other nations in the world was quickly advanced. For instance, the preferences dates for applicants from mainland China and Mexico moved up to July 1, 2010. The preference date for the Philippines is December 1, 2006, and India, September 22, 2003.

According to the September bulletin, the reason behind the rapid acceleration of preference dates is to prompt demand for the visa. Accordingly, should the demand for such visas increase, the preference date could drop back. Because the preference date could again quickly change, parties interested in pursuing the employment visa should work quickly.

As is the case with all visa situations obtaining an EB-3 can be difficult. Accordingly, for the best outcome most find it beneficial to work with a lawyer who handles and understands the complexities of obtaining an employment visa. Doing so could dramatically impact the outcome of the case.
